
The National Highways Authority of India (NHAI) has recently achieved crucial arbitration victories in two significant disputes related to the Panipat–Jalandhar section of National Highway 44. This success underscores the Indian government’s commitment to safeguarding public funds while reinforcing accountability in highway infrastructure projects. These rulings are monumental for India’s growing road transport sector, which plays a vital role in fostering tourism, enhancing trade, and improving regional connectivity.
The disputes at hand saw claims exceeding Rs. 8,375 crores raised by concessionaires against NHAI, along with counterclaims worth Rs. 2,888.64 crores from the authority itself. After thorough hearings and technical evaluations, the arbitral tribunal ruled in favor of NHAI, awarding a net amount of Rs. 819.96 crores.
This outcome is seen as a significant triumph for the NHAI, particularly as India ramps up its investments in transport infrastructure aimed at enhancing travel experiences and reducing logistics costs, ultimately benefiting interstate tourism connectivity.
The Panipat–Jalandhar stretch of NH-44 is a key transport corridor in northern India, linking essential cities, industrial zones, and various tourism attractions across Haryana and Punjab. The arbitration proceedings were primarily focused on claims concerning alleged project delays, loss of toll revenue, escalation costs, as well as demands for compensation and concession period extensions.
In the initial arbitration case, concessionaires put forward claims exceeding Rs. 5,443 crores, attributing losses to toll collection issues, termination payments, and disputes arising under the concession agreement. NHAI vehemently opposed these claims, asserting that the project’s termination was justified due to deficiencies and defaults caused by the concessionaire.
After reviewing all relevant contractual records, technical documents, and evidence provided by both sides, the tribunal dismissed several substantial monetary claims against NHAI. Furthermore, the tribunal acknowledged essential counterclaims and defenses from the highway authority related to breaches of project obligations and financial responsibilities.
After making the necessary adjustments, the tribunal ultimately awarded approximately Rs. 115.73 crores in favor of NHAI, inclusive of applicable interest.
The second arbitration involved claims of over Rs. 2,931.79 crores from a claimant who sought compensation for escalation costs, project delays, prolongation expenses, and other alleged financial repercussions arising during the highway’s execution.
NHAI countered these demands effectively, providing evidence showing issues with compliance, the inadequacy of supporting documentation, and the failure to establish a direct link between the claims and the losses cited.
The tribunal largely rejected the claims against NHAI but upheld several key counterclaims filed by the authority. Following the necessary adjustments and settlements, the tribunal awarded an additional net amount of Rs. 704.23 crores to NHAI.
These rulings represent some of the most consequential arbitration outcomes related to highway infrastructure disputes in recent times.
The successful defense in these arbitrations highlights the critical need for strong contract enforcement, diligent project monitoring, and comprehensive legal preparedness within India’s infrastructure sector. The arbitration successes related to the Panipat–Jalandhar stretch follow another recently established victory concerning the six-laning project of the Kamrej–Chalthan section of NH-48 in Gujarat. In that instance, claims against NHAI hovering around Rs. 174.49 crores were significantly diminished, with the tribunal awarding merely Rs. 54 lakhs.
These outcomes collectively reinforce NHAI’s approach to promoting financial discipline, stringent contract management, and the protection of taxpayer investments in infrastructure. As India’s highway network modernizes, such legal victories are anticipated to bolster investor confidence and ensure more efficient project delivery within the rapidly evolving transport sector.
